I think he was counting the time to do the run, not the years of preparation. I know people who've just turned up and passed - but they are racers with years of club competition under their belts. Looking at SB on Youtube (there isn't much footage) I guess he'd be quite a way off the standard required.

Well that press release sure looks like a win to me. M. Butler may have just done to the ESF what Bosman did to football club owners. On face value, the Eurotest is dead and every Francophile L2 and L3 owes Simon a beer.
Now we just need to see what's negotiated for reciprocal employment rights for Brits in France following Brexit…. where's the fingers crossed emoji?

Sadly I don't think there'll be a large number of French keen to instruct in England on English based activities such as cricket or Morris Dancing.....

SIM, society International mountaineers, are taking it as a victory in their dispute with the French climbing authorities. They have it splashed all over their Facebook page.

@stewart woodward, I'm not surprised. The judgment basically completely reverses the responsibilities of any nation's awarding body vs. the equivalent French body. Instead of A N Other nation having to prove that their qualification matches the indigenous French one, the French now have to prove not only why it doesn't match it but more importantly why it would actually matter.
In the case of something like the Eurotest where they are the only nation insisting on a pass as a prerequisite to teaching, they've got no hope. Every other EU regulating body is going to say it's a nonsense requirement.
Added to that is the statement that you are presumed to be at the requisite qualification level (if qualified under your National Association) unless they can prove otherwise. So even if the ESF want to fight it, other EU Instructors will have the right to teach as long as and until there is a final judgement in the EU courts. That'll take as long as or longer than this case did because it won't just be Simon Butler fighting it, it'll be every other EU Ski Instructors' Association.

@rjs, yes I believe you're right for full time instructors but an L2 can still do 4? weeks temporary peak season work without it. It's Interski's business model, isn't it?

Only for the top level. You can reach in Italy with L2 or 3 without many restrictions. Interski instructors do this all the time.

I was speaking to a Spanish instructor today. I see him around a bit but haven't chatted with him before. He told me he was a regional coach and has the top Spanish ski instructor exam, he also has a French masters in sports science. I asked him what he was up to.
"waiting to get my carte pro so I can teach"
He applied for it at the start of the first confinement. Normally the law is they have 3 months to respond, if they don't in that time they automatically have to issue the carte pro
"so what happened?"
"Oh it went to their equivalence board to look at my experience, Spanish qualifications etc, they said I don't have enough FIS points and have to take the Eurotest. This was after 7 months".
I spoke about the Simon Butler case but he replied that he didn't want to be tied up in court cases for years and has a date for the Eurotest in the New Year sometime and thinks he should be ok.
So the French are still trying it on.

@davidof, Didn't a large group of Spanish Instructors get a 'pass' in recent years for their association signing up ?
To be fair, the Spanish have their own form when it comes to blocking Instructors from other EU Nations in an effort to 'keep it local'.
