Just had an email from Steamboat, and it appears that they, or at least someone has registered the term "Champagne Powder"...!

From advice our company trademarks and patents lawyer has given us in the past, a UK court would not accept that trade mark, since 'champagne' and 'powder' are recognized words. Which begs the question of 'Apple' and 'Windows' I know - but maybe Apple and Microsoft have such menacing teams of lawyers that no one wants to take them on - and they may also be relying on being able to accuse other companies as passing off their products if they use 'Apple or 'Windows'

Its a funny old game Trademarks, Copyright, Patent and IP rights, very good for the lawyers to make money out of.
I have been invloved with a few cases, one was when I was making toys we were sent a bill for £40K for using a Smiley Face, a French guy had trademarked the smiley face and then they tried it on by billing me, funny thing was that they sort of forgot that they had no registration for the toy market and only had a 2 dimsional image registered.
Their bill was sent back with a nice little letter from our solicitors for damages

A friend's dad once sent a cease and desist note to another company who was using his very distinctive cartoon firefighter... The retunred letter showed that it was actually a royalty free clip art image from one of those clipart CDs...
