Mail for help.Help!!

Log in to snowHeads to make it MUCH better! Registration's totally free, of course, and makes snowHeads easier to use and to understand, gives better searching, filtering etc. as well as access to 'members only' forums, discounts and deals that U don't even know exist as a 'guest' user. (btw. 50,000+ snowHeads already know all this, making snowHeads the biggest, most active community of snow-heads in the UK, so you'll be in good company)..... When you register, you get our free weekly(-ish) snow report by email. It's rather good and not made up by tourist offices (or people that love the tourist office and want to marry it either)... We don't share your email address with anyone and we never send out any of those cheesy 'message from our partners' emails either. Anyway, snowHeads really is MUCH better when you're logged in - not least because you get to post your own messages complaining about things that annoy you like perhaps this banner which, incidentally, disappears when you log in :-)

French Speeding Fines

 Poster: A snowHead
Poster: A snowHead
I was wondering if anyone has had any experience appealing speeding fines on the basis that the notification wasn't received? The driver of our group isn't disputing the fine, but as he didn't receive the initial notification due to working abroad, he was unable to pay at the discounted rate.

Any advice would be much appreciated.

Are they UK or French resident?

Were they driving French or UK registered car?

justatheory, not getting the notification because you weren't available wouldn't be much of a defense in the UK would it?

Flashed or stopped?

If stopped you should be given the notification at the time of the offence. You pay that and if you fail to so the fine goes up. And up!

Sorry, no help on the appeals process.

I believe there is no reciprocal deal with the UK and France for points and or fines retrospectively. If you get stopped there and then its an on the spot fine and and cash. My 500 euro fine was on the spot and cash. Tried the credit and debit card but he insisted on cash.

Been flashed a few times by static cameras but heard nothing.

What would they do if you haven't got enough cash on you?

Don't they take you to a cashpoint? Ultimately i expect they would confiscate the car

Sorry, I should've mentioned that he was flashed driving a French hire car and received the fine through the post. Not using it as a defence, just thought they might give him an opportunity to pay at the inital amount, as the fine has significantly escalated in his absence - which he admits is completely his own fault for not getting his mail checked more frequently.

Give you a lift to the cash machine or take your car off you I'd expect

A friend of mine was stopped for speeding, and had his licence taken away there and then. Paid the fine and his other half could drive the car so they were okay.

The Gendarmes were less than impressed with his comment that he could have a beer now Wink

for a really high speed they can just confiscate the car on the spot, I believe. When I got a speeding fine (80 euros - 43 mph through a sleepy dorp with no speed limit signs, so I got to keep my car) the guy told me where the nearest cashpoint was, took our passports and waited for us to come back and exchange the dosh for the passports.

If someone fails to check their post, or if they are away for a while, have someone else to check it, that's a pretty poor reason for clemency!

 You know it makes sense.

Throw it in the bin. Speeding fines from fixed cameras are not legally enforceable across borders, even within the EU.

Can the hire car company not blacklist you from hiring with them again, does such thing exist?

I think your mate is stuffed. Presumably the hire car company just took the money off his credit card? No chance of appeal in my view. If it had been a UK registered car i would have said ignore it.

I have been hit with a fine from Italy which didn't arrive at my home address until nearly 12 months after the event. Legal advice was to pay because I had been in a hire car at the time. The authorities only have to send the initial fine notice to the hire company (as the registered keeper), the hire company returns the notice to the authorities with your details, they then pass it on to the driver. By this time, you are more than likely to have missed the reduced rate period and will no doubt have a hiked up fine due to the delay in paying / telling you. If you fail to pay, one option is the hire company charge your credit card that you used to hire the car - the other option is they register the fine against your name which could cause problems next time you want to hire a car there. Some countries register this with the courts as a default fine and most airlines use Eboarders alerts to tell local police who is on each flight and they then check to see if there is an arrest warrant out in the country they are landing in.......

Different matter if you were in your own uk registered car. In that case, I would rip it up.

I had to pay £200. Peace of mind doesn't come cheap.
