Deliaskis, maybe you're right. However, whichever way these laws (or otherwise) are exercised, it will hopefully stop quaint little Austrian ski villages becoming ghost towns because all the property has been sold to foreigners. You've only got to look in some coast fishing towns on the south Cornwall coast to see the effects.
Out of interest, which immo was it in Hofgastein? (I think I may have asked you this before)

Actually, I think that's got more to do with the lack of decent jobs in the area.

david@mediacopy, we paid 103,000 Euro for ours 2 and a half years ago. I think the new build's are quite a bit more. I'll try and find that website for the new development I was on about, that'll give a better idea.
Kramer, I think that probably has something to do with it. However there was a programme on the BBC a few months ago - they were going round Britain looking at the property prices and what causes the price to go up or down. They were in this Cornish fishing village and there were so many properties that were shut because they were holiday homes. Just to confirm this, the property prices were ridiculously high because of the demand for holiday property but because of the sale of those properties, the village had lost it's character. I think this is what the Austrian's are trying to prevent happening in their alpine villages.

Deliaskis, It's possible for foreigners to buy in Tirol, again EU law override what the locals would like to think. I know a chap that has sold properties in st anton to brits. But like you say the locals seems to make it hard and few properties come up. I've a property in Styria and as far as I know the situation is the same as in Salzburgerland. I know Kersh mentioned a 10% rule for Gastein but I've never heard of that where i am. My local town hall has been attempting to get me to declare the property is my perm residence, which on legal advice I've refused to sign as it's our second home. I think the local town hall just want to get more federal taxes. When we looked both here and in salzburgerland the estate agents we dealt with never raised an issue that we're not austrian. Our neighbour is the finance director of the local council and clearly has no issue with us as property owners and how we use it.

Since posting before, I am beginning to see that whatever rules I have understood to have existed are more myth than rule.

It is more tax advantageous ( future CGT) to have your home classed as a permenant residence rather than a holiday home. We were told that you can buy permenant residence homes as an investment but could not go there on holiday. The lawyer laughed as he explained to us that in reality this is an unworkable law as you could go out and check on your property several times a year but not for a holiday. He also explained that he had two of these homes in the same resort as second homes. I don't think it contravenes any EU law as this rule also applies to Austrian nationals. The rule is political in that it appeases locals who fear of a boom in property prices and there are very few new build properties granted holiday home status. We are very aware that to upset our local neighbours would not be the wisest thing to do as like deliaskis we do rely on them when we are not there, but having spoken to a few feel that they would prefer you to rent out your place to bring extra money into the area rather than leaving it empty.
