Ah. I see that David did not consider he was stealing bandwidth. Many webhosts would think otherwise. Not all will be aware of the process of stopping it. Moreover, it can reduce the flexibility to link to their own server from another site - and, I think, inhibit Google images, which some may want to have access. I would not be pleased if it happened from my sites without my consent (as some smiley hosts, for example, explicitly give).

Well, that's obvious, but that's nothing to do with alleging theft. Whether someone has paid for something is irrelevant. One can be accused of stealing something that has cost the victim nothing.
I've asked you to refer us to any relevant legislation on this. Let's go there, before getting carried away.

Not only is that technically incorrect it's absurd, just because you can steal something doesn't mean you're obliged to.

It's not technically incorrect at all. Go to many of the News International sites, or countless others, and try to hot-link from them. It's correct that hot-linking is prevented.
By the way, there's something I'd like to take up with you on the etiquette front.

Not it is not, it's simply that you don't know how. Again your lack of understanding of the media and technology really ought to stop you making statements like this but it never seems to.

David Goldsmith, dear me. I didn't think you would believe it OK to steal if you could get away with it. Most hosts would simply not think it worth the hassle to complain with a view to prosecution, though actions taken against wifi thieves suggests they might be successful. The Seedsite puts the case against hotlinking rather well.

OK, does anyone else have any views about hot-linking?
Have you done it? Do you believe you were stealing bandwidth by doing so? Do you believe that sites hosting photos can prevent hot-linking?
achilles, it's rather ungentlemanly to accuse someone of theft in public. Why not discuss it with your fellow gentlemen at the Castle Hill Club? (are you able to discuss it with the ladies, or are they prevented from entering or speaking in the building?)

and also of your breach of the snowheads' terms and conditions in publishing material that is the copyright of News International in this thread.
PS - you think it is wrong that I thought you wouldn't believe it OK to steal???? How bizarre.

Elizabeth B, you're confused, I'm confused.
The famous snowHeads 'registration terms' and 'terms and conditions' say nothing about hot-linking, which is commonly practised in this parish.
What is the moderators' position on this? Does it comprise theft of bandwidth, in the moderators' view? Does it comprise theft of copyright, in the moderators' view?
If the answer is "yes" I'll most willingly stop it, as I'm sure will everyone else who has fun with it.

roga, threads go where they will in this forum. Always have. I suppose the mods could split his thread - but I don't see the point. After all David's criticism of the SCGB attitude to copyright, whilss at the same time appearing to have a cavalier attitude to it is interlinked in this thread's posts.
How have you got on in approaching the SCGB on your problem? I gather James is away at the moment - but I see you had some good advice in the SCGB forum.

David Goldsmith, bandwidth theft is not mentioned in T&Cs. Publishing on these pages is done by a a variety of methods. Perfectly acceptable hotlinking from snowmediazone, for example, direct upload (available to some members) or , in your case by linking to another site without, you having gained the site owner's consent - if that's what you did. Whatever the means of you getting a picture to this site, once it is here it is you that has caused it to appear. If you have the copyright owner's consent, I can see no breach of T&Cs. If you haven't, I can. Whether or not the mods agree to hotlinked pictures, it leaves you poorly placed to criticise the SCGB for not observing copyright.

Ahhhh, hotlinking, I think we'll get the 20pages of circular argument now!!
Hot Linking can be a bandwidth Killer, but it can also be a very good way of pulling people into your site.

Winterhighland, of course it can. Which is why some sites specifically choose to encourage it. Others do not. Which is why it's nice to check before hotlinking.

Elizabeth B, thanks. There will be no more hot links from me on this site.
Can we revert to the issue of snowHeads news photos? They are published, I think always, without credit to the photographer or source. They are re-hosted by snowHeads, presumably by copying them from the original hosting sites.
What is your position on this?
Are these photos copyright or public domain? If the former, are they published with permission?

Just for people's information, James Cove is now back and has responded immediately:

I got back late last night from a trip to Switzerland so was unaware of the incident, but I have just been assured the mistake was genuine, apologies have been made and they have been accepted. There are no hard feelings between the parties involved. |
Good of him to be so quick to respond and hopefully it's a good sign from the SCGB.
I have asked him about flagging up procedures to the people on the team who seem to forget periodically what the correct way of doing this is.
achilles, yup I got some advice on the forum

Hurtle, it is great stuff but I'm clueless about where we're at right now. I thought I knew what a hotlink was but the theft of bandwidth stuff has me stumped. All a futile waste of words. In the final analysis, if you lose control of your own intellectual property it's your own fault. No point talking of legal action or accusing others of theft (even if they have blatently nicked it), if your stuff was so precious in the first place you should protect it. There. Copyright Bode Swiller. My lawyers are watching.
