Mail for help.Help!!

Log in to snowHeads to make it MUCH better! Registration's totally free, of course, and makes snowHeads easier to use and to understand, gives better searching, filtering etc. as well as access to 'members only' forums, discounts and deals that U don't even know exist as a 'guest' user. (btw. 50,000+ snowHeads already know all this, making snowHeads the biggest, most active community of snow-heads in the UK, so you'll be in good company)..... When you register, you get our free weekly(-ish) snow report by email. It's rather good and not made up by tourist offices (or people that love the tourist office and want to marry it either)... We don't share your email address with anyone and we never send out any of those cheesy 'message from our partners' emails either. Anyway, snowHeads really is MUCH better when you're logged in - not least because you get to post your own messages complaining about things that annoy you like perhaps this banner which, incidentally, disappears when you log in :-)

Blackcombe sued by B.C. government over crash

 Poster: A snowHead
Poster: A snowHead
Blackcomb Skiing Enterprises is being sued by the B.C. government to recover the health care costs of a snowboarder injured 2 years ago while skiing at the resort. Amanda Yan was snowboarding on the Crystal Road run, when her snowboard caught an edge, causing her to slide down a steep embankment and over a cliff, the legal action claims. ...She suffered a mild traumatic brain injury, dislocated two vertebrae and fractured three other vertebrae, fractured her right thigh bone, a wrist bone in her right hand, and suffered injuries to a lung and left kidney, the plaintiff claims.

The province claims the ski hill was negligent in failing to erect a barrier that would have prevented Yan from going down the snow bank and over the cliff, and failed to erect a sign warning users of a sharp drop-off and cliff.

Sad but falling off a cat track can't realistically be anything other than user error. Clearly the BC government want to bankrupt one of their own major tourist revenue generators by forcing ski resorts to place padding around every tree inbound if you take it to the extreme.

Wow. Interesting that a third party is bringing the action.

It's just going to close all the "road" type runs if Gov wins... Not only here with some of the nicest road runs but also across most resorts...

Well they could erect barriers and we would have to pay about 4 times if not more (a guess) as much for lift passes...

Interesting lack of response on this item - is it true that hiding things in News is a good way of ensuring that there aren't many responses? wink

Rather boringly the article fails to disclose if she was wearing a helmet - if not surely she was asking for traumatic brain injury (there that should get it going wink

Nah, just another sad example of the problems with litigious societies with no win no fee litigation...

under a new name, it's the government suing to recover medical costs though - that's the weird thing for me. maybe the NHS should look into that?

Its a brave new world of 2 lots of ambulance chasers chasing every ambulance.

"Injured in an accident? Not your fault? Call NHS direct (they might as well be of some use).

Where there's a blame theres a credible route to public deficit reduction"

Arno, sure, what I meant was that although it's Canada, it's representative of the attitude so increasingly present that it's someone else's fault, so we can sue.

Uninsured losses (i.e. too cheap to pay for decent cover?) let someone else pay.

Probably cheaper, safer and more fun all round to ban snowboarding, really... Evil or Very Mad

Presumably BC has some form of regulations regarding ski resort operation so W-B can simply counter sue the state government for not regulating them properly?

Pretty obvious who the winners are.

Clearly this whole thing is ridiculous. Why would gov sue whistler? It just opens it up for everyone else to sue. Surely they should set an example by not suing!?

Very dubious precedent being set that will hopefully be laughed out of court. What is the next stage, suing the snowboarder to recover health care costs because of participation in an activity the state has decided was an unnecessary exposure to risk! Shocked

It is unlikely to happen in Europe like that as we still dont pursue the group actions and lawsuits like they to in the states.
