Blackcomb Skiing Enterprises is being sued by the B.C. government to recover the health care costs of a snowboarder injured 2 years ago while skiing at the resort. Amanda Yan was snowboarding on the Crystal Road run, when her snowboard caught an edge, causing her to slide down a steep embankment and over a cliff, the legal action claims. ...She suffered a mild traumatic brain injury, dislocated two vertebrae and fractured three other vertebrae, fractured her right thigh bone, a wrist bone in her right hand, and suffered injuries to a lung and left kidney, the plaintiff claims.
The province claims the ski hill was negligent in failing to erect a barrier that would have prevented Yan from going down the snow bank and over the cliff, and failed to erect a sign warning users of a sharp drop-off and cliff.

Sad but falling off a cat track can't realistically be anything other than user error. Clearly the BC government want to bankrupt one of their own major tourist revenue generators by forcing ski resorts to place padding around every tree inbound if you take it to the extreme.

It's just going to close all the "road" type runs if Gov wins... Not only here with some of the nicest road runs but also across most resorts...
Well they could erect barriers and we would have to pay about 4 times if not more (a guess) as much for lift passes...

Arno, sure, what I meant was that although it's Canada, it's representative of the attitude so increasingly present that it's someone else's fault, so we can sue.
Uninsured losses (i.e. too cheap to pay for decent cover?) let someone else pay.
Probably cheaper, safer and more fun all round to ban snowboarding, really...
Presumably BC has some form of regulations regarding ski resort operation so W-B can simply counter sue the state government for not regulating them properly?

Clearly this whole thing is ridiculous. Why would gov sue whistler? It just opens it up for everyone else to sue. Surely they should set an example by not suing!?

Very dubious precedent being set that will hopefully be laughed out of court. What is the next stage, suing the snowboarder to recover health care costs because of participation in an activity the state has decided was an unnecessary exposure to risk!
