Anyway, snowHeads really is MUCH better when you're logged in - not least because you get to post your own messages complaining about things that annoy you like perhaps this banner which, incidentally, disappears when you log in :-)

Check out the case studies. They make sobering reading - especially the one titled "$8.3 Million Verdict for Minor Suffering Traumatic Brain Injury"

The difference between the US and the UK here is that settlements in the US are massive. As far as I'm aware, each of the case studies quoted would constitute the legal green light for a lawsuit in the UK, but the compensation would be much lower.

$8.3 m is not THAT far away from what someone with the rest of their lives to deal with might get over here. A kid requiring 24 hour care until the day they die would get a similar kind of sum I reckon. However, being the USA, things might have been exaggerated somewhat... traumatic brain injury might mean a large bruise.

Remember... in the US large settlements are awarded because they know that they are generally reduced on appeal.

Don't forget also that in many cases, US damages are awarded by a jury rather than a judge. Juries are believed to use damages sometimes as a way of punishing the defendant (for their conduct in the case or because they are unpopular for other reasons), rather than simply compensating the plaintiff, which leads them to make ridiculously large awards (as English juries sometimes did in libel/slander trials until judges were given power to intervene). Add to that the fact that US law provides in some areas for the award of 'punitive damages' (a contradiction in terms), and high awards are unsurprising ($8.3m in this case may not have been ridiculous, though).
