Fantastic service from Goretex, my 3 year old Salomon outdoor running/walking shoes are no longer waterproof, both the retailer and Salomon said as they were over 3 years old they couldn't do anything.
I contacted Goretex directly and they are going to replace them for me Looks like they stand by their "GORE-TEX(R) Guarantee to Keep you Dry is for the lifetime of the product."
They also will contact both the retailer and Salomon to inform them of what they should do if this happens in the future.

pam w, you are correct, they did say if they were worn out, or the sole was hanging off or any part of the upper was visibily damaged then they wouldn't be covered.

grrr - my 3yr old (or might be 4?) Salomon Goretex boots that have been used as everyday shoes on and off, have now split where the boot bit joins the sole bit. I'm guessing this makes them "beyond the lifetime of the product", and hence not covered.
